BUILD A BASH (THE "CONTEST") -CONTEST RULES
Build-a-Bash is an online contest in which entrants can have fun creating their dream party for a chance to win a real party from Koodo Mobile.
This Contest is intended for viewing and participation in Canada only (excluding Quebec) and shall be construed and evaluated according to the laws of Canada (excluding Quebec). Please do not enter if you are not a legal resident of, and not located in, Canada (excluding Quebec) at time of entry. Void Where Prohibited By Law. No Purchase Necessary.
1. CONTEST PERIOD: Starting August 6, 2009 at 9:00:00 AM Eastern Standard Time (EST) and ending October 11, 2009 at 11:59:59 PM EST (the "Contest Period").
2. ELIGIBILITY: To enter and be eligible to win, entrants must be a legal resident of Canada (excluding Quebec), thirteen (13) years of age or older as of the Contest start date. Persons in any of the following categories are NOT eligible to participate or win prizes: (a) any person who, at any time on or after August 6, 2009, was or is a director, officer, or employee of KOODO MOBILE, a business name and division of TELUS Communications Company and "Koodo Mobile" means TELUS Communications Company (the "Sponsor"), or any other division of the Sponsor, its parents, subsidiaries, affiliates, dealer or retailer principles or employees, service agencies, or advertising and contest agencies; (b) individuals engaged in the development, production or distribution of materials for the Contest or engaged in the administration or execution of this Contest (collectively with the entities in 2(a), the "Contest Entities"), and (c) any person domiciled with any of the above.
3. HOW TO ENTER: Enter at www.buildabash.ca (the "Site"), read and accept these Contest Rules and follow the instructions to register. For the purposes of these Contest Rules, any eligible person who registers in the Contest is defined as an entrant ("Entrant"). Entrant must have a valid Facebook website account and password in order to participate in the contest. Limit of one registration per Entrant. Each week that an Entrant logs-in to the Site, they will receive one (1) entry into the Weekly Draw for that week.

Limit: one (1) Weekly draw entry per Entrant per week throughout the Contest Period. Entries received from one week do not roll over to subsequent weeks.
There are a number of ways to earn entries into the Grand Prize Draw, as described in sub-section (a) below.
Throughout the Contest Period, Entrants can become hosts ("Hosts") of their own parties by creating a Party Page, and/or guests ("Guests") at other parties, as described below. Once Entrants have registered and logged in to the Site using their Facebook password, they may create a "party" (thus becoming a Host) or view other parties that their "Facebook Friends" have either created or joined on the Site. Entrants may create a maximum of one (1) party and join a maximum of four (4) parties during the Contest Period (thus becoming a Guest), or, if they do not create any parties, they may join a maximum of five (5) parties. The name of the Host and all Guests will be displayed on the Party Page. Once they have created or joined a party, Entrants can earn points ("Points") for that specific party through voting, participating in educational modules, and/or by entering Codes, as explained below. Points are not transferable between parties that an Entrant has created or joined. Each Point that Entrants earn for a party is equal to one (1) entry in the Grand Prize Draw. Points earned accumulate through the Contest Period.
(a) Voting:
Points can be earned by Entrants participating in a voting system found on each Party Page. A Party Page is the section on the website created by a Host and dedicated to that Host's party. Entrants will be able to vote for one (1) of two (2) thematic party options on each of the 12 different "levels" once each level is made available for voting or "unlocked". The first eight (8) of these party elements will be unlocked automatically on a weekly basis, unless unlocked earlier by the party reaching the points requirement before the "date unlocked"; see table below for details. The four (4) remaining elements ("BONUS LEVELS", below) will be unlocked on the "date unlocked", but only once the party has earned the required number of points.
Entrants will earn five (5) points per vote to a maximum of sixty (60) points per party (5 points x 12 elements) for the party(ies).

(a) [Educational modules]: On each Party Page, there will also be eight (8) educational modules (quizzes, videos, etc.) available as an additional way to earn points for that specific party. Once an Entrant has earned points from a module for one (1) specific party, they will not be able to earn points on other party pages from that specific education module. Entrants can earn a maximum of 200 points through these modules (8 modules x 25 points).
(b) Koodo Codes: On each Party Page there will be a form where entrants can enter a "Koodo Code" to earn points for that specific party. Koodo Codes will have different values depending on the method used to distribute them; see table below for details. There will be two basic kinds of Koodo Codes: Unique Codes and Generic Codes; methods of distribution to remain at the sole discretion of Sponsor, who reserves the right to change or add methods of distribution. Unique codes can only be used one (1) time.

Each party can earn up to a maximum of thirty-six thousand (36,000) points throughout the Contest Period. (Sponsor reserves the right to change this limit at any time throughout the Contest Period.)
Hosts of a party can block Guests from their party at their own discretion. Once a Guest is blocked from a party, any Points the blocked Guest has earned will be removed from the party's Point total. All Koodo Codes and Points used by the blocked Guest for that specific party cannot be transferred to another party. Blocked Guests cannot be re-invited to a party from which they have been blocked.
4. DRAWS: Approximately two (2) days following the end of each week of the Contest, Retail Communications Group, Inc. (the "Contest Judges") will randomly draw one (1) entry (a "Potential Weekly Winner" and, if verified, a "Weekly Winner") from among all eligible entries received for that specific Weekly Draw, by use of an algorithm. The odds of winning depend on the total number of eligible entries received for that Week. Each Weekly Winner will be eligible to win a Weekly Prize (See Rule #5(b) below), subject to verification of eligibility under these Contest Rules.
On or about October 15, 2009, at approximately 2:00:00 PM CT, the Contest Judges will randomly draw one (1) entry (the "Potential Grand Prize Winner" and, if verified, "Grand Prize Winner") from among all eligible entries received for the Grand Prize Draw. The odds of winning depend on the total number of eligible entries and Points received throughout the Contest Period. The Potential Grand Prize Winner will be eligible to win the Grand Prize (See Rule #5(a) below), subject to verification of eligibility under these Contest Rules.
5. PRIZES:
(a) One (1) Grand Prize (the "Grand Prize"): (a) The Grand Prize consists of a party for the Grand Prize Winner (the "Grand Prize Winner") and up to three hundred (300) guests of his/her choice. Selected elements of the Grand Prize Winner's party may also be included in the Grand Prize party at the Sponsor's discretion. Transportation to/from the party location for Winner and/or guests is not included with the Grand Prize. Total approximate retail value (ARV) of Grand Prize: $50,000.00 CAD. Party location, venue and details to be selected at the sole discretion of Sponsor. Transportation, personal expenses and all other expenses not specified herein are the sole responsibility of the winner.
(b) One hundred (100) Weekly Prizes (ten (10) available per week): Each Weekly Prize consists of one (1) gift card to a retailer to be selected at the sole discretion of the Sponsor. ARV $100.00 CAD.
Prizes are not transferable or redeemable for cash and must be accepted as awarded, with no substitutions of any kind, except by the Sponsor, who reserves the right to substitute a prize (or portion thereof) of comparable or greater value, at its sole discretion. Taxes, if any, as well as any other costs and expenses associated with prize acceptance and uses not specified herein are the Winners' responsibility. All prize details are at the Sponsor's sole discretion.
6. HOW TO CLAIM YOUR PRIZE: In order to be eligible to win a prize, Potential Winners, or if a Potential Winner is under the age of majority, his/her parent or legal guardian, must first correctly answer, without mechanical aid and assistance, a mathematical skill-testing question that will be administered online. All Weekly Winners will be contacted using Facebook's messaging system where they will be directed to enter their mailing address on a secure webpage, and the prize will then be automatically mailed to each verified Winner's address as provided. Potential Grand Prize Winner will be contacted by phone, mail or email with instructions on how to claim the prize. If a Winner or Potential Winner is found to be ineligible, or not in compliance with these Contest Rules, declines to accept a prize, if Sponsor is unable to contact a Potential Winner within a reasonable period, or in the event that a prize notification or prize is returned undeliverable, the prize will be forfeited and, at the Sponsor's sole discretion, prize may be awarded to an alternate. Alternates will be randomly selected using the same algorithm that will be used to select the winners. Potential Winners will be required to furnish proof of identification. Before being declared a Potential Winner, or, if the Potential Winner is under the age of majority, his/her parent or legal guardian will be required to execute and return a Declaration and Complete Release and Waiver form ("Release") within seven (7) business days from the time it is postmarked as having been sent by the Sponsor or its representative, or the prize will be forfeited. The Grand Prize Winner's guests will also be required to sign a Release.
Allow 6 to 8 weeks for verification and shipment of your weekly prize after verification. Contest Entities shall not be held responsible for any delays in awarding prizes for any reason outside of their control. Prizes will only be delivered to verified Winners.
By accepting a prize, each Winner consents to the use of his/her name, address (city and province/territory of residence), voice, and statements relating to the Contest or Sponsor, and photographs or other likenesses, without further compensation, notification or permission in any publicity or advertising carried out by Sponsor or any related entities in any and all media now known or hereinafter developed without territorial or time limitation, except where prohibited by law.
CONDITIONS OF ENTRY:
7. By entering, entrants (i) acknowledge compliance with these Contest Rules including all eligibility requirements and, (ii) agree to be bound by the decisions of the Sponsor and/or Contest Judges, made in their sole discretion which shall be final and binding in all matters relating to this Contest. Entrants who have not complied with these Contest Rules are subject to disqualification and all associated entries and points will be void.
8. Sponsor is not responsible for late, lost, damaged, stolen, misdirected, mutilated, garbled, illegible or incomplete postage-due submissions of entry requests or points. Proof of transmission (screenshots or captures, etc.) and/or mailing does not constitute proof of delivery. All entries/submissions/points become the property of Sponsor and in no case shall be returned to sender.
9. The Sponsor reserves the right to disqualify any entrant's registration in the Contest (and void all associated entries/points) or entitlement to a prize if, in the sole discretion of the Sponsor, it determines or suspects that the entrant has attempted to undermine the legitimate operation of the Contest by cheating, hacking, deception, or other fraudulent, deceptive or unfair playing practices (including any entries generated by script, macro, robotic, programmed, or any other automated means or any other means which subvert the entry process).
10. If a dispute arises regarding who registered on the Site, the entry will be deemed to be submitted by the authorized account holder of the email address provided at time of registration and he/she must comply with these Contest Rules. Authorized account holder is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider, or other organization responsible for assigning email addresses for the domain associated with the submitted email address.
11. As a condition of registering on the site and entering, Entrants agree and agree to procure the agreement of any guests: (a) to release Contest Entities from any and all liability, loss or damage incurred with respect to participating in the Contest or the awarding, receipt, possession, and/or use or misuse of any prize or any travel related thereto, (b) that under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental, consequential, or any other damages, other than for actual out-of-pocket expenses; (c) all causes of action arising out of or connected with this Contest, or any prize awarded, shall be resolved individually, without resort to any form of class action; and (d) any and all claims, judgments, and awards shall be limited to actual out-of-pocket costs incurred, and in no event will entrants be entitled to receive attorneys' fees and court costs.
CONTEST OPERATION:
12. Sponsor reserves the right in its sole discretion to cancel, modify or suspend this Contest at any time, if fraud, technical failures, including any network server or hardware failure, viruses, bugs, errors in programming, or any other errors or other causes corrupt the administration, security, integrity or proper play of the Contest or for any other reason at the Sponsor's sole discretion. In the event of cancellation, Sponsor reserves the right to select the Winners from among all eligible, non-suspect entries received up to time of such cancellation. In no event will the Sponsor be liable for more than the stated number of prizes available in the prize category in question.
13. Contest Entities do not warrant that access to the Contest will be uninterrupted. Contest Entities are not responsible for any problems that may arise, including but not limited to: (a) lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, Web sites, or other connection, availability or accessibility problems arising in connection with or over the course of the Contest; or (b) communications failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions or hardware or software malfunctions, failures or difficulties; or (c) failure of personal computers and/or software and hardware configurations, any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in connection with the administration of the Contest, the processing of mail or entries, the offering or announcement of any prize or in any prize notification documents; or (d) for any other errors of any kind relating to or in connection with the Contest, whether human, mechanical, clerical, electronic, or technical in nature; or (e) the incorrect or inaccurate capture of information, or the failure to capture any information in connection with the Contest; or (f) damage to a user's system occasioned by participation in this Contest or downloading any information necessary to participate in this Contest.
DISCLOSURES:
14. Any attempt by an Entrant or other individual, to deliberately damage the Site or any website or undermine the legitimate operation of this Contest, including but not limited to any fraudulent claims, is a violation of criminal and civil laws. Should such an attempt be made, Sponsor reserves the right to seek remedies and damages (including attorneys' fees) from any such individual, to the fullest extent permitted by law, including criminal prosecution. Entrant engaging in any of the foregoing activities may be disqualified (and all associated entries will be void) and will forfeit any prize(s) won.
15. In the event of any conflict between these Contest Rules and Contest details contained in promotion materials (including but not limited to point of sale, television, and print advertising, promotional packaging, and other promotion media), the details of the Contest as set forth in these Contest Rules shall prevail.
16. All issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, or the rights and obligations of entrant and Sponsor in connection with the Contest, shall be governed by, and construed in accordance with, the substantive laws of the Province of Ontario, without regard to Ontario or any other conflicts of law principles. All entrants consent to the jurisdiction and venue of Ontario.
17. The invalidity or unenforceability of any provision of these Contest Rules shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Contest Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. In particular, Sponsor's employees are not authorized to waive, modify or amend any provision or provisions of these Contest Rules in any manner whatsoever.
18. This Contest is subject to all Federal, Provincial/Territorial, and Municipal laws.
